Amway Quixtar Loses Court Ruling

Amway Quixtar lost a federal court dispute Wednesday to 3 junior independent business owners over an arbitration agreement that Amway makes its IBOs sign when they become distributors. The agreement was described as "unconscionable and unenforceable," according to the Ninth Circuit Court of Appeals. The arbitration agreement essentially forces distributors to reconcile legal disputes privately instead of filing lawsuits in court.

The independant business owners succeeded in challenging Quixtar's policy which now makes it possible to sue the company in a court of law, which is the aim of the IBOs as they claim that Amway's Quixtar is a pyramid scheme.

Having agreed with the lower court, The Ninth Circuit Court of Appeals said Quixtar's arbitration process is "simply too tainted to be saved through minor adjustments because it is so permeated with unconscionable provisions."

In a written response from Quixtar, the company left the following statement:

Today's ruling on the arbitration section of the Quixtar contract was expected. The Ninth Circuit historically has been skeptical of contract arbitration.

The decision is merely a procedural step on a long road to trial. In fact, the original motion ruling that Quixtar appealed in this case was written more than two years ago. Since that time, concerns about the arbitration process have been fully addressed.

We remain confident that a full and fair hearing will validate our view that the allegations in this suit are without merit.

Once a household name and reputedly the key to fortune for modern salesmen hoping to live out a Horatio Alger myth, the Amway brand faded from the American market years ago, tarnished by legal and regulatory problems.

The direct seller of everything from health and beauty items to household cleaners repeatedly fought allegations that it was a pyramid scheme. The company also paid $20 million in fines in a Canadian criminal fraud case in 1983.

In 2000, after Amway become part of an umbrella company called Alticor Inc., the Amway name was dropped in the U.S. and Canada. The hope was that the company could emerge remade in the world of online sales under a new moniker: Quixtar.

Now, as Amway's 50th anniversary approaches in May, Alticor is retiring the inert Quixtar label and pouring millions of dollars into reviving the Amway brand in North America with market research, national TV commercials and ads in newspapers, magazines and online. The company will use a transitional name, Amway Global, before reverting in about a year to Amway.

Amway Warns of Bogus Internet Charity Scam

Amway Corporation (Quixtar in the U.S. and Canada) has discovered an internet scam that uses a bogus Amway charity as a lure. Amway cautions individuals to be on the lookout for e-mails from a group calling itself the "Amway Children Charity Foundation". Please be advised that this is not an Amway-sanctioned program and the name, program and people indicated in the e-mails are not related to Amway in any way and do not have Amway's authority or support.

The goal of the scam is to trick people into sending money to the fraudulent charity. The bogus group sends an e-mail informing the recipient that he/she has been selected as a recipient of a grant to help establish a children's help center to assist poor children in the area. A nomination code number may be given, and banking information is requested. If the recipient responds, an indemnity bond of several hundred euros is demanded. The e-mails may be signed from "Dr. Kevin Brown" or someone else claiming to be a grant processing officer.

Fraudulent activities involving payment or release of personal financial information can be committed electronically from a remote location, including overseas. Committing these activities in cyberspace allows scam artists to act quickly and cover their tracks before the victim becomes aware of the theft.

Quixtar Announces Fifth Year of Billion Dollar Sales

Quixtar Inc. today announced fiscal 2007 sales of $1.072 billion, the fifth consecutive year in which the company surpassed the billion-dollar mark. The results represented a slight decline from the previous year's sales of $1.12 billion, which were the best in Quixtar's nine-year history.

Results were affected minimally by actions the company took to terminate the business of a few Independent Business Owners in August of 2007 after they refused to change unacceptable practices.

Quixtar Independent Business Owners (IBOs) earned $363 million in bonuses and other incentives for their business efforts in 2007, which also included $70.1 million in sales at Quixtar's Partner Stores.

Direct-marketing firm Quixtar Inc., a sister company of Amway Corp., has sued 30 people who anonymously posted what it considers disparaging remarks about Quixtar in blogs and online forums and in YouTube.com videos.

In the lawsuit filed this past week in Ottawa County Circuit Court, Quixtar seeks an injunction and damages of more than $25,000 against the posters, identified only as John Does.

Quixtar develops and manufactures nutrition, beauty and cleaning products that are marketed in the United States and Canada through a tiered selling system, hiring entrepreneurs to sell its products. Parent company Alticor Inc. uses the Quixtar name for its U.S. and Canadian direct sales unit and sells products throughout the rest of the world as Amway Corp.

Among the products Quixtar representatives sell are Nutrilite vitamin, mineral and dietary supplements, Artistry skin care and cosmetics, XS energy drinks, and air and water purifiers.

The case could be called Amway versus the Internet, or some might argue, Amway versus free speech.

The Ada Township-based multi-level marketing giant this week filed a sweeping suit in Ottawa County Circuit Court against 30 people classified as John Does for disparaging the company in blogs, online forums and YouTube videos.

The suit, filed by Quixtar, the online version of Alticor Inc.'s Amway business, asks the court for an injunction and damages of more than $25,000 against the anonymous posters.

The company is planning to ask the court to approve subpoenas of companies ranging from godaddy.com to YouTube to figure out who posted the materials, said spokesman Rob Zeiger.

The company believes the videos and other postings are part of an organized effort by former distributors, including Orrin Woodward, of Grand Blanc, under court order not to disparage the company or disclose proprietary information.

"Quixtar has attempted to identify the various defendants by reviewing the offending Web sites, blogs and videos," according to the suit.

"Due to the policies of the Internet service providers, which host the various Web sites, blogs and videos, Quixtar has been unable to identify the responsible parties."

A judge has ruled in favor of Quixtar Inc. in three lawsuits involving several of the direct marketer's former distributors, saying Friday they must abide by confidentiality and noncompete clauses until their disagreements with the company can be arbitrated.

Quixtar is the name that Alticor Inc. uses for its U.S. and Canadian direct sales unit that is known elsewhere as Amway Corp. Alticor, which is based in Kent County's Ada Township, announced in June that it will start phasing out the Quixtar name and rebuilding its Amway brand in the United States and Canada.

Kent County Circuit Judge Paul Sullivan issued a preliminary injunction that prohibits the former distributors, which the company refers to as independent business owners, from using their former Quixtar networks for any business-related purpose.

The Team of Destiny may have had its destiny fulfilled, but not in the intended manner.

According to a press release and several news reports, a Michigan judge has ruled in favor of Quixtar on two of the three lawsuits brought before them by former employees and associates. Orinn Woodward and Chris Brady were the heads of a group formerly called the Team of Destiny (now just known as TEAM, standing for "Together Everyone Achieves More), an organization employed by Quixtar to train their independent business owners (IBOs) on how to sell Quixtar products and recruit other sales persons. Brady and Woodward had a disagreement with Quixtar and wanted to be released from their "no compete" clause in their contracts. Several other high-ranking Quixtar members joined them as well.

Amway Scraps Quixtar Label

Direct-sales giant Alticor Inc. confirmed today that it will scrap its 7-year-old Quixtar Inc. label during the next one-and-a-half to two years and focus on rebuilding its Amway brand in North America.

The Alticor name itself will be relegated to the back burner.

Employees received the news last week in an internal memo from company Chairman Steve Van Andel and President Doug DeVos, The Grand Rapids Press reported.

Back at the Spring COMMON user group meeting, IBM announced the second of its annual Innovation Awards. The awards are designed to showcase the achievements of iSeries and System i users who have done--as the name suggests--innovative things with the platform. We promised we would give you the inside stories of the winners, and here they are.

Our intent was to profile the 2006 winners and finalists for each category. We weren't able to reach everyone (although we tried, repeatedly), so we have had to give a snapshot of some of the companies that IBM deems the most innovative in their use of the System i5.

IBM reports having received more than 50 nominations across the five different award categories of Application Deployment, Business Resiliency, Infrastructure Simplification, i5/OS Leadership, and Education Excellence.
